2.1 Acceptance of Terms

By accessing or using the Agarta platform in any capacity — including but not limited to browsing the website, creating an account, participating in virtual experiences, or using any API or integration — you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy.

If you are accessing Agarta on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2.2 Platform Description

Agarta is an immersive AI-powered training and education platform offering:

• Virtual and augmented reality learning environments
• 3D content simulation and interactive experiences
• Online training modules and virtual classrooms
• AI-powered tutoring, assessment, and personalization tools
• Data-driven learning dashboards and analytics

2.3 Eligibility

• Users must be at least 13 years of age (or the minimum age defined by applicable law in your jurisdiction)
• Users under 18 must have verifiable parental or institutional consent
• All users must provide accurate and complete account information
• Users must not be prohibited from accessing digital services under applicable law
• Institutional accounts require a valid organizational agreement

All content on the Agarta platform, including but not limited to software, VR/XR experiences, 3D environments, learning modules, AI models, interfaces, logos, trademarks, and proprietary content, is the exclusive intellectual property of Hope Land Canada Inc. or its licensors.

Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use content solely for authorized educational and personal purposes. This license does not include the right to copy, modify, distribute, sell, or exploit any platform content.

2.6 Subscription and Payment Terms

2.7 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AGARTA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR: indirect, incidental, special, consequential, or punitive damages; loss of profits, data, or business opportunities; interruption or loss of service; user misuse of the platform; third-party service failures; or VR/XR-related discomfort or health effects.

Maximum aggregate liability is limited to amounts paid by the user in the 12 months preceding the claim.
